Citi Mobile Terms and Conditions

1. Definitions:

"Cellular Service Provider(s)" shall mean any person/organization permitted by the Government of India or any competent authority to provide mobile/cellular services that support voice and data traffic.

"Citibank Account" shall mean any Indian Rupee account including savings/current account, Credit Card account, or any other account held in India by an Indian citizen, at locations approved by Citibank.

"Citi Mobile Facility" or "Facility" shall mean the facility which allows the Customers to carry out transactions on the Customer's Mobile Phone using the software application provided by Citibank and a GPRS Internet connection.

''Client Application'' shall be the software provided by and modified from time to time by Citibank using which, the Customer will be able to access account related information through a GPRS Internet connection.

"Customer" means a person who is a Citibank Account holder and who has accepted these Terms and Conditions.

''Intermediaries'' shall mean various cellular service providers or other organizations or entities nominated by such cellular service providers which shall provide, to the Customer, the GPRS services which are necessary for provision of the Facility.

"Mobile Phone(s)" shall mean a wireless enabled mobile phone(s) or any type of mobile phone(s) owned/in the control of the Customer which supports voice and data exchange offered by any Cellular Service Provider.

''Mobile Phone Number'' means a distinctive Mobile Phone number last updated on the records of Citibank by the Customer on Citibank Online, through the call centre or in writing either through any form provided by Citibank or otherwise for the purpose of availing the Facility.

''Mobile Payments'' means financial transactions done through the use of Mobile Phones based on the information exchanged between Citibank and its Customer. A Mobile Payment involves Debit/Credit to the Customer's Account on the basis of instructions received through a Mobile Phone.

"Specific Terms and Conditions" means the Specific Terms and Conditions, as may be either contained in the Citibank Account Terms and Conditions to be communicated to the Customer from time to time, applicable to the Citi Mobile Facility.

"Terms and Conditions" means these Terms and Conditions including any amendments and any and all annexure, schedules, exhibits, appendices attached to it or incorporated by reference from time to time. These Terms and Conditions are supplemented by and are in addition to the Specific Terms and Conditions that shall be communicated to the Customer prior to availing the Facility. In case there is a conflict or repugnancy between these Terms and Conditions and any Specific Terms and Conditions, these Terms and Conditions would prevail for all intents and purposes.

Terms used hereunder but not defined herein shall have the meaning assigned to them under the Citibank Account Terms and Conditions and/or Internet Banking Terms and Conditions and/or the Specific Terms and Conditions.

In these Terms and Conditions all reference to Customer in masculine gender shall be deemed to include the feminine gender.

2. Availability and Usage

The Facility shall be available only to those Customers who fulfill the following eligibility criteria:

The Facility shall be made available to the Customer only at his request.

This Facility shall be made available only to the Customers satisfying the eligibility criteria and shall be provided at the sole discretion of Citibank and may be discontinued by Citibank at any time, with prior notice to the customer.

The Customer would be required to download the Client Application on his Mobile Phone for using and accessing this Facility. The Customer shall then be able to access the Citibank Account using the Facility, only after due authentication of the Customer is done by means of verification of the Debit/Credit Card number and IPIN allotted by Citibank to the Customer or through any other mode of verification as may be stipulated by Citibank at its sole discretion. The Customer acknowledges that Citibank shall authenticate the identity of the Customer only through the Debit/Credit Card number and IPIN allotted by Citibank to the Customer

The Customer shall be able to carry out transactions including but not limited to fund transfer from one account of the Customer to another or to a third party account maintained with Citibank and/or any other bank (which allows this facility), payment of Credit Card dues, obtaining information on Citibank Account balance and Citibank Account transactions summary.

3. General

The Customer understands and acknowledges that this Facility is an extension of accessing the internet banking facility on Citibank Online and that all users of this Facility shall be bound by the same Terms and Conditions that govern Internet Banking, IPIN and Mobile Phone Banking Facilities.

4. Indemnity

In consideration of Citibank agreeing to provide the Facility to the Customer, the Customer hereby irrevocably agrees, to indemnify and keep Citibank indemnified, at all times hereafter, from all losses, damages, costs, legal fees, charges and expenses and consequences whatsoever, suffered or incurred by Citibank on account of any claims, actions, suits or otherwise instituted by the Customer, or any third party whatsoever, arising out of or in connection with the use of the Facility and any and all transactions initiated by the use of the Facility, whether with or without the knowledge of the Customer, or whether the same have been initiated bona fide or otherwise which transactions, the Customer hereby acknowledges, Citibank has processed on the transaction instructions and authority of the Customer in accordance with these Terms and Conditions and other applicable Specific Terms and Conditions, as the case may be. The Customer further agrees and confirms that this indemnity shall remain valid and subsisting and binding upon the Customer notwithstanding partial withdrawal of the Facility.

5. Confidentiality and Disclosure

To the extent not prohibited by applicable law, the Citibank shall be entitled to transfer any information relating to the Customer and/or any other information given by the Customer for utilization of the Facility to and between it's branches, subsidiaries, representative offices, affiliates, representatives, auditors and third parties selected by Citibank, wherever situated, for confidential use in and in connection with the Facility. Further, Citibank shall be entitled at any time to disclose any and all information concerning the Customer within the knowledge and possession of Citibank to any other bank/association/financial institution or any other body. This clause will survive the termination of this agreement.

6. Termination

The Customer acknowledges and understands that if the IPIN remains unused for a period of six (6) months from the date it is issued by Citibank to the Customer, then the IPIN shall become invalid and the Customer shall not be able to avail the Facility, until the Customer applies for a new IPIN. The closure of the Accounts of the Customer shall automatically terminate the Facility. Citibank may suspend or terminate Facility without prior notice to the Customer, if the Customer commits a breach of any of these Terms and Conditions and/or the Specific Terms and Conditions or any specific regulations laid out by RBI from time to time with regard to Mobile banking or Citibank receives information of the death, bankruptcy or lack of legal capacity of the Customer.

Except as otherwise provided by the applicable law or regulation, Citibank reserves the right to terminate the Facility and/or expand, reduce or suspend the transactions allowed using this Facility, change the process and transaction limits associated with this Facility based on security issues, at any time, without any prior notice to the Customer.

Citibank also reserve the right at any time with notice, to add/alter/modify/change or vary all of these Terms and Conditions.

7. Disclaimers:

Citibank shall not be liable for:

Citibank does not recommend, endorse or make any representation or warranty of any kind regarding the quality of the service provided by the Cellular Service Provider(s) and/or performance or operation of the Client Application and/or Mobile Phone used for the Facility. The Customer shall be solely responsible for the selection of the Mobile Phone/Cellular Service Provider(s) and for all issues/disputes between the Customer and the Cellular Service Provider(s) and/or the manufacturer of the mobile Phone.

8. Governing law and jurisdiction

The construction, validity and performance of these Terms and Conditions shall be governed in all respects by the laws of India. The parties hereby submit to the exclusive jurisdiction of the competent Courts at Mumbai, India which courts shall have jurisdiction in the matter to the exclusion of any other courts, irrespective of whether such other courts have similar jurisdiction in the matter.

9. Grievance Redressal

The Customer is advised to check the Citi Mobile section at www.citibank.com/india for details on how to address a grievance to the bank related to the facility.
