
"Cellular Service Provider(s)" shall mean any person/organization permitted by the Government of India or any competent authority to provide mobile/cellular services that support voice and data traffic.
"Citibank Account" shall mean any Indian Rupee account including savings/current account, Credit Card account, or any other account held in India by an Indian citizen, at locations approved by Citibank.
"Citi Mobile Facility" or "Facility" shall mean the facility which allows the Customers to carry out transactions on the Customer's Mobile Phone through a Wireless Internet connection, SMS and/or Unstructured Supplementary Service Data (USSD).
''Client Application'' shall be the software/website provided by and modified from time to time by Citibank using which the Customer will be able to access his/her Citibank Account related information through a GPRS/Wireless Internet connection.
"Customer" means a person who is a Citibank Account holder and who has accepted these Terms and Conditions.
''Intermediaries'' shall mean various cellular service providers or other organizations or entities nominated by such cellular service providers which shall provide to the Customer, services for the Wireless Internet connection, which are necessary for provision of the Facility.
"Mobile Phone(s)" shall mean a wireless enabled mobile phone(s) or any type of mobile phone(s) owned/in the control of the Customer which supports voice and data exchange offered by any Cellular Service Provider.
''Mobile Phone Number'' means a distinctive Mobile Phone number registered on the records of Citibank by the Customer on Citibank Online, through the call centre or in writing either through any form provided by Citibank or otherwise for the purpose of availing the Facility.
''Mobile Payments'' means financial transactions done through the use of Mobile Phones based on the information exchanged between Citibank and its Customer. A Mobile Payment involves Debit/Credit to the Customer's Account on the basis of instructions received through a Mobile Phone.
"Specific Terms and Conditions"means the Specific Terms and Conditions, as may be either contained in the Citibank Account Terms and Conditions to be communicated to the Customer from time to time, applicable to the Citi Mobile Facility.
"Terms and Conditions" means these Terms and Conditions including any amendments and any and all annexure, schedules, exhibits, appendices attached to it or incorporated by reference from time to time. These Terms and Conditions are supplemented by and are in addition to the Specific Terms and Conditions that shall be communicated to the Customer prior to availing the Facility. In case there is a conflict or repugnancy between these Terms and Conditions and any Specific Terms and Conditions, these Terms and Conditions would prevail for all intents and purposes.
Terms used hereunder but not defined herein shall have the meaning assigned to them under the Citibank Account Terms and Conditions and/or Internet Banking Terms and Conditions and/or the Specific Terms and Conditions.
In these Terms and Conditions all reference to Customer in masculine gender shall be deemed to include the feminine gender.
The Facility shall be available only to those Customers who fulfill the following eligibility criteria:
The Customer understands and acknowledges that this Facility is an extension of accessing the internet banking facility on Citibank Online and that all users of this Facility shall be bound by the same Terms and Conditions that govern Internet Banking, IPIN and Mobile Phone Banking Facilities. Customer understands that by registering for the Facility, the Customer is also registered for the use of the Interbank Mobile Payment Service (IMPS) and agrees to abide by the terms of usage thereto, as may be stipulated from time to time.
Citibank shall use its best endeavors to carry-out transaction instructions received by it from the Customer within such time as may be specified by Citibank, however, Citibank does not guarantee that the fulfillment of transaction instructions or availability of the Facility within such specified time frames since provision of the Facility depends on various electronic medium and technology used from time to time and may pass through Intermediaries, that may cause delays and snags in receipt/transmission of any transaction instructions received by/from Citibank from/by the Customer. All transaction requests on Citi Mobile are instantaneous in nature and effected immediately. Hence these requests may be irrevocable and Citibank will be unable to undo or reverse any such transaction request after it has been issued. Accordingly, Citibank shall not be liable for any loss, damage whether direct or indirect, costs, charges or expenses incurred by the Customer due to a delay/inability in carrying out or reversing the transactions and/or providing this Facility.
The Customer hereby understands and acknowledges that certain category of transactions carried out through Client Application and/or SMS/USSD can only be done to the linked accounts or the accounts pre-registered on his payee list on Citibank Online.
Citibank reserves the right to, from time to time at its sole discretion, but with prior intimation to the Customer, charge fees for the provision of any and/or all of the Facility.
In consideration of Citibank agreeing to provide the Facility to the Customer, the Customer hereby irrevocably agrees, to compensate and keep Citibank saved, harmless and protected now and at all times hereafter, from all losses, damages, costs, legal fees, charges and expenses and consequences whatsoever, suffered or incurred by Citibank on account of any claims, actions, suits or otherwise instituted by the Customer, or any third party whatsoever, arising out of or in connection with the use of the Facility and any and all transactions initiated by the use of the Facility, whether with or without the knowledge of the Customer, or whether the same have been initiated bona fide or otherwise which transactions, the Customer hereby acknowledges, Citibank has processed on the transaction instructions and authority of the Customer in accordance with these Terms and Conditions and other applicable Specific Terms and Conditions, as the case may be. The Customer further agrees and confirms that this undertaking shall remain valid and subsisting and binding upon the Customer notwithstanding partial withdrawal of the Facility.
To the extent not prohibited by applicable law, the Citibank shall be entitled to transfer any information relating to the Customer and/or any other information given by the Customer for utilization of the Facility to and between its branches, subsidiaries, representative offices, affiliates, representatives, auditors and third parties selected by Citibank, wherever situated, for confidential use in and in connection with the Facility. Further, Citibank shall be entitled at any time to disclose any and all information concerning the Customer within the knowledge and possession of Citibank to any other bank/association/financial institution or any other body. This clause will survive the termination/usage of the Facility.

Citibank does not recommend, endorse or make any representation or warranty of any kind regarding the quality of the service, including but not limited to GPRS, provided by the Cellular Service Provider(s) and/or performance or operation of the Client Application on any particular Mobile Phone used for the Facility. The Customer shall be solely responsible for the selection of the Mobile Phone/Cellular Service Provider(s) and for all issues/disputes between the Customer and the Cellular Service Provider(s) and/or the manufacturer of the Mobile Phone.
The construction, validity and performance of these Terms and Conditions shall be governed in all respects by the laws of India. The parties hereby submit to the exclusive jurisdiction of the competent Courts at Mumbai, India which courts shall have jurisdiction in the matter to the exclusion of any other courts, irrespective of whether such other courts have similar jurisdiction in the matter.
